एनजीटी के आदेशों से सरकार की रिटैन्शन पाॅलिसी सवालों में आदेशों को उच्च न्यायालय में चुनौती देने की बन रही रणनीति

शिमला/शैल। नैशनल ग्रीन ट्रिब्यूनल ने हिमाचल प्रदेश के सारे "Green forest and core areas'' में हर तरह के निमार्ण पर प्रतिबन्ध लगा दिया है। यही नही राष्ट्रीय उच्च मार्गो के तीन मीटर के दायरे में भी यह रोक लगा दी है। प्रदेश में हुए अन्धा धुन्ध निमार्ण पर सरकार की प्रताड़ना करते हुए ट्रिब्यूनल ने कहा है कि "If such unplanned and indiscriminate development is permitted, there will be irreparatable loss and damage to the environment, ecology and natural resources on the one hand and inevitable disaster on the other'' ट्रिब्यूनल ने कहा है कि यदि कोई व्यक्ति बिना अनुमति के पहाड़ को काटने या वन क्षेत्र को नुकसान का दोषी पाया जाता है तो हर दोष के लिये उस पर पांच लाख का जुर्माना लगाया जायेगा। नये निर्माणों पर ट्रिब्यूनल ने कहा है कि
"Beyond the core, green /forest area and the areas falling under the authorities of the Shimla Planning Area, the construction may be permitted strictly in accordance with the provisions of the Town and Country Planning Act. Development Plan and the Municipal laws in force. Even in these areas, construction will not be permitted beyond two storeys plus attic floor."
However, if any construction particularly public utilities (buildings like hospitals, schools and offices of essential services but would definitely not include commercial, private builders and any such allied buildings) are proposed to be constructed beyond two storeyes plus attic floor then the plans for approval or obtaining NOC shall be submitted to the authorities concerned having jurisdiction over the area in question."
ट्रिब्यूनल ने अपने आदेशों की अनुपालना सुनिश्चित करने के लिये निदेशक टीसीपी की अध्यक्षता में एक कमेटीे का भी गठन किया है। इस कमेटी के अन्य सदस्यों में सचिव शहरी विकास विभाग, निदेशक वाड़िया इन्स्टीच्यूट आॅफ हिमालय जियालोजी राष्ट्रीय आपदा प्रबन्धन के अधिकारी और प्रदूषण नियन्त्रण बोर्ड के सदस्य सचिव शामिल हैं। यह कमेटी सरकार को This committee shall also advise the state of Himachal Pradesh for regulating traffic on all roads, declaring prohibited zones for vehicular traffic, preventing and controlling pollution and for management of municipal solid waste in Shimla. The recommendation of this committee should be carried out by the state government and all its departments as well as local authorities without default and delay. ट्रिब्यूनल ने यह आदेश योगेन्द्र मोहन सेन गुप्ता और शीला मल्होत्रा की याचिका पर सुनाये हंै। ट्रिब्यूनल ने प्रदेश के टीसीपी और प्रदूशण नियन्त्रण बोर्ड के 20 सदस्यों के खिलाफ कारवाई करने की भी अनुशंसा की है।
एनजीटी के इन आदेशों से प्रदेश के प्रशासनिक और राजनीतिक हल्कों में हड़कंप की स्थिति पैदा हो गयी है क्योंकि राजधानी शिमला में अवैध निर्माण के हजारों मामलें हैं बल्कि यह कहना ज्यादा सही होगा कि यह अवैध निर्माण अपरोक्ष में राजनीतिक संरक्षण के चलते हुए है। क्योंकि इन्हें नियमित करने के लिये सरकार नौ बार रिटैन्शन पाॅलिसियां ला चुकी है। प्रदेश उच्च न्यायालय भी इन निर्माण पर कई बार तल्ख टिप्पणीयां कर चुकी है। एनजीटी के इन आदेशों के बाद नगर निगम शिमला के भी कईे पार्षद इन्हे उच्च न्यायालय में चुनौती देने का फैसला लेने का विचार बना रहे हैं। इन आदेशों की अनुपालना करना सरकार के लिये भी एक बड़ी चुनौती बन सकता है।
इन आदेशों के बाद नये निमार्णों के लिये बहुत सारी कठिनाईयां पैदा होने की आशंका हो गयी है। क्योंकि ऐसे क्षेत्रों में निमार्ण नही हो सकेगा जिनकी ढलान 35% से अधिक होगी। इन आदेशों के बाद स्मार्ट सिटी की सारी परियोजना का प्रारूप भी अब नये सिरे से बनाने की आवश्यकता आ खड़ी होगी। क्योंकि स्मार्ट सिटी के नाम पर बहुत सारेे ऐसे कार्य प्रायोजित है जिनकी अनुमति इन आदेशों के तहत मिल पाना संभव नही होगा।
