2017 की शिकायत पर अब जांच के आदेश

शिमला/शैल। राज्य सूचना आयोग ने 11 अप्रैल को पारित अपने एक आदेश मे प्रदेश के अतिरिक्त मुख्य सचिव स्वास्थ्य को न्यूरोसर्जन डा. जनक के खिलाफ 2017 में आयी एक शिकायत पर वांच्छित कारवाई शीघ्र पूरी करने के निर्देश दिये हैं। इस कथित शिकायत पर क्या कारवाई हुई है इस बारे में आरटीआई एक्टिविस्ट डा. बन्टा ने स्वास्थ्य विभाग से जानकारी मांगी थी। स्वास्थ्य विभाग द्वारा यह जानकारी न दिये जाने पर यह मामला राज्य सूचना आयोग में पहुंच गया था जहां पर यह आदेश हुए हैं।
After hearing both the parties in detail and perusing the case file, the Commission observes that the PIO has denied the information with regard to RTI application dated 08-08-2018 by invoking the provisions of section 11(1) of the RTI Act. In this regard, the commission feels that the PIO has not followed the prescribed time schedule as provided in the Act with regard to dealing 3rd party information as provided in the Act. Further, considering the submissions made by both the parties, the Commission is of the view that as the enquiry has not been culminated, the provisions of section 8(1) (h) would be applicable in this case and according , it is ordered that as and when the same is accomplished, the PIO still provide complete in formation to the appellant, strictly as per his RTI application, free of cost. Further, the Commission also feels that as considerable time has elapsed to take action on the complaint made during September 2017, the matter is brought to the notice of Principal Secy., Health Govt. of H.P Shimla for appropriate action. With these observations and directions, these two second appeals are disposed off by a single order. Inform the parties accordingly.
इन आदेशों में यह सामने आया है कि यह कथित शिकायत सितम्बर 2017 में वन मन्त्री ठाकुर सिंह भरमौरी और तत्कालीन मुख्यमन्त्री द्वारा की गयी थी। 2017 में प्रदेश विधानसभा के लिये चुनाव हुए थे जिनमे भरमौरी हार गये थे और सत्ता भाजपा के हाथ आ गयी थी। लेकिन जब सितम्बर 2017 में यह शिकायत हुई थी तब उस समय तो कोई चुनाव आचार सहिंता लागू नही थी फिर इस शिकायत के बाद करीब चार माह तक यह सरकार सत्ता में रही थी। ऐसे मे जब शिकायत करने वाला स्वयं मन्त्री और मुख्यमन्त्री रहा हो तो उस समय इस पर जांच क्यों नही हो पायी। क्या अधिकारियों की नजर में यह शिकायत राजनीति से प्रेरित थी और इसी कारण से इस पर कोई कारवाई की आवश्यकता नही समझी गयी। लेकिन अब जिस ढंग से आरटीआई के माध्यम से इस शिकायत को अब स्वास्थ्य सचिव तक ला दिया गया है उससे कुछ अलग ही संकेत उभर रहे हैं। ऐसे में अब स्वास्थ्य सचिव पर नजरें आ गयी है। क्योंकि सूचना आयोग के निर्देशों के बाद इसमें कुछ तो कारवाई करनी ही पड़ेगी।
