क्या अभी भी बेनामी निर्माण चल रहे हैं?

शिमला/शैल। सोलन के डगशाई क्षेत्र के खील जाशली में एक कैलाश वर्मा के माध्यम से एक बिल्डर फ्लैटस का निर्माण कर रहा है। इस बिल्डर ने यह जमीन एक कांगड़ा के व्यक्ति के नाम पर ली है और इसके लिये संबंधित विभागों से वांच्छित अनुमतियां नही ली गयी हैं यह आरोप है एक राजीव कटारिया का जिसका अपना काॅटेज भी इसी क्षेत्र में है। राजीव कटारिया का आरोप है कि उसके काटेज से करीब 700 मीटर दूर जहां से लिंक रोड़ शुरू होता है उसकी निचली ओर से फ्लैटस बन रहे हैं। इन फ्लैटस के लिये लिंक रोड़ को जोड़ने के लिये एक सड़क का निर्माण किया जा रहा है। कटारिया के मुताबिक यह सड़क सरकारी जमीन पर अतिक्रमण करके बनाई जा रही है और इसके लिये लोक निर्माण आदि संबंधित विभागों से कोई अनुमति नही ली गयी है। इस निर्माण में लोक निर्माण विभाग की पक्की सड़क को भी तोड़ा गया है। इस तरह यह निर्माण वाहनों के लिये खतरा बन गया है। बल्कि पिछले दिनों यह सड़क धस भी गई और इसमें एक टिप्पर लुढ़क गया और उसमें ड्राइवर को चोटें भी आयी परन्तु कोई शिकायत पुलिस को नही दी गयी।
कटारिया के मुताबिक इस सड़क निर्माण से उसके काटेज के रास्ते में भी परेशानी हो गयी है। वहां पर गाड़ी मोड़ने आदि में कठिनाई आ गयी है। कटारिया का आरोप है कि उसकी जमीन की ओर अतिक्रमण करके पक्का डंगा लगाया जा रहा है। कटारिया ने 20-7-2019 को इसकी सूचना डगशाई पुलिस को भी दी। पुलिस ने मौके पर दो मुख्य आरक्षी भेजे। इन्होने लोक निर्माण के संबंधित कनिष्ठ अभियन्ता को भी  बुलाया जो वहां नही था और उसने एक इन्सपैक्टर को वहां भेजा। इन्सपैक्टर ने कैलाश वर्मा को चेतावनी दी और कैलाश वर्मा ने पुलिस को लिखकर दिया कि वह इस अतिक्रमण को तुरन्त हटा देगा परन्तु अभी तक ऐसा हुआ नही है।
इससे यह स्पष्ट हो जाता है कि कैलाश वर्मा सरकारी जमीन और सड़क पर अतिक्रमण कर रहा है तभी तो उसने पुलिस को लिखकर दिया। राजीव कटारिया के मुताबिक फ्रलैटस के निर्माण की शायद अनुमतियां नही ली गयी हैं और जमीन किसी कांगड़ा के व्यक्ति के नाम पर ली गयी है। जमीन हिमाचली के नाम पर लेकर फ्लैटस बाहर का आदमी बना रहा है। राजीव कटारिया की शिकायत पर जब पुलिस मौके पर पंहुच जाती है और लोक निर्माण का इन्सपैक्टर भी आ जाता है तो स्वभाविक है कि इस निर्माण को लेकर भी पूरी जानकारी ली गयी होगी क्योंकि कटारिया ने यह सब अपनी शिकायत में लिखा हुआ है। चर्चाओं के मुताबिक फ्लैटस पटियाला के तीन लोग बना रहे हैं और जमीन कांगड़ा के एक मनीष के नाम पर है। कांगड़ा के आदमी के नाम पर जमीन होने से भूसुधार अधिनियम की धारा 118 के तहत सरकार से अनुमति लेने की आवश्यकता खत्म हो जाती है और निर्माण के दौरान ही जांच करने का कोई प्रयास नही किया जाता है कि जिसके नाम पर जमीन है उससे यह पूछा जाये कि निर्माण के लिये उसके पास पैसा कहां से आया। इस मामले में पुिलस और लोक निर्माण विभाग कैलाश वर्मा के लिखकर देने के बाद शांत होकर बैठ गये हैं जबकि यह निर्माण सीधे बनामी के संकेत दे रहा है।

        I am resident of village Kheel Jashali where I have my cottage on the hill side of road, which goes from the main highway to Kauron-Kaintharhi starting from Kheel Ka Morh. My cottage is at a distance of 700 meters from the point the link road starts, whereas on the lower side of the hill, a construction is going on and seems that some commercial flats are being constructed over there. While doing his construction, party constructing is making a road down side of the hill connecting to the link road and in the process without taking any measurements or permission from the concerned PWD Department. He has damaged the road and has also cut over the portion of the road to include in his road which goes downside. The said road which he has made is clearly an encroachment upon the metal portion of the PWD road as well as on the berm of the road and thus the road in front of my gate has been narrowed down and as a result thereof neither I can turn my vehicle in front of my gate nor the vehicles which are running on the road are safe to run as the road which goes down has been cut from the portion of the existing PWD metalled road. Even the cemented limiting stones fixed on the berm of road have been broken and removed.

        For the last six months, I have been making requests to Shri Kailash Verma, who is the person getting the construction done at the spot to rectify this illegality, but he has always been saying that he will do, but never acceded to my requests. Recently his road which he made also caved in as a result a Tipper loaded with material over turned and fell into ‘Khud’ in his land which also resulted into injuries to its driver, but it seems that no information was given to the police regarding that.

        On 20.07.2019, while I came to my cottage, I saw that a ‘pucca dunga’ was being made on the side of his land and again the encroachment on the road was made much more than earlier, so that he could have the road going down to his construction area. On my repeated requests he has just been saying that he will do the needful, but it was all in the air. I informed the matter to the local police and as a result two Head Constable from Dagshai Chowki also came, who called even Shri Gian Thakur, J.E. PWD of the area who was busy in Advocate General office in Shimla at that time, but he sent one of his Inspectors who also warned Shri Kailash Verma, for which he promised that he will rectify the things within two days and he gave it in writing to the police for the same, but till date nothing has been done rather the construction is going on at full swing and the encroachment is being made permanent.

        I request you that please take immediate action and stop the construction and encroachment which is being done by the commercial builder who are getting the flats constructed through Mr. Kailash Verma by purchasing the land in name of some local resident of Kangra without the necessary permissions from the concerned departments.

        An immediate action is needed to stop encroachment and further damage to the public property. I shall be highly obliged in case an early is taken and I am informed about the progress of the issue.
